oh yeah....
I think, if akai could die as easy as that, he will not ever made BO as busy as this far.
By the way, akai must be still alive, because I guess he will be Shiho/Sherry/Haibara's soulmate.
Hattori with Kazuha, Kudo with Ran, Akai with Miyano, Jodie with James
Well, by the Law of All Anime, the senpai character will die doubtlessly.
But if we consider how Akai himself is a representation of Char Aznable, there are possibilities of him being alive.
Char himself faked death at the end of Zeta Gundam, and Okiya's name is somewhat similar to Char's birthname, Casval (Kiyasubaru, note it's similarity with Okiyasubaru).
If you want my honest opinion, there is no way Akai survived getting his brains blown out.
I REALLY REALLY want it all to be a conspiracy, though. I REALLY hope the dude staying at Shinichi's (whom we're supposed to think is Burbon) is Akai, undercover in the Black org. I REALLY hope it was all just a way for Conan and Akai to mislead the Black Org (which involved making the FBI think he's dead, too).
BUT the expression on Conan's face when Jodie gave his cell phone back kinda cemented it for me. I think that Akai realized Conan was smart, and left him a dying message (the fate of the cell phone being that message). He figured that Conan would realize the implications and would know who killed him.
And to top it all off: I read somewhere that in an interview, Gosho said he wasn't bringing Akai back. I don't remember the reasons he gave (maybe something about "I don't see any more use for his character"). I'm thinking that Gosho doesn't want two silver bullets against the black org. The show is about Conan, and two silver bullets would take the attention off of Conan and his crazy-a** skillz (C.A.S. for short, tehe)
*ahem* Anyway...
To sum it all up: Akai is dead, no matter HOW MUCH we want him to be alive.
it seems like he's pretty much dead. though when he was first shot, I immediately thought "blanks" and akai's pained reaction to the gunshot seemed a bit delayed. however, the fingerprints verify that the body had touched the phone before at some point. I'm pretty sure the fingerprints belong to akai, as the takagi does not state that there were any fingerprints on the phone besides jodie's and conan's. the theory that the body belonged to the BO man from the hospital is interesting, but like I said, his fingerprints do not appear to have been on the phone. actually, this might've been the case. but we know that akai's prints touched the phone at some point as well. so than 4 different prints should've been on the phone, at least, no? but only 3 were identified by the police. hmm.
then again, akai get's shot straight in the head, and this time he reacts immediately. though the way he fell from the shot seemed odd - there appeared to be to much force in the way he flew away. since he died instantly he should've just slumped to the ground, right?
another thing to consider is that akai's last few words are kinda odd as well. he does state something like "so it's come to this" or something like that. but something tell's me that he'd react more with more surprise.
but then again, "raiha falls". very interesting. and the fact that, if he was going to take every precaution, that he'd have a gun pointed at rena first. also, the fact is that akai appears to only notice the porche later on, though he should've been able to see it beforehand, which seems to indicate that he must've known that it was there.
though, let's say he is alive. how then was he able to create a fake death with such little time to plan? and without having a chance to conspire with rena beforehand.
the fact that there can only be one silver bullet really also sways me toward the opinion that akai is really dead. how could akai seemingly get shot, fall back in the car, and switch bodies with the BO guy from the hospital and slip out of the car before rena looks back?
I don't think he's dead, because of all reasons for this stated above and Akai Shuuichi just isn't a man to walk blindy into a trap he knows about and get himself killed.
I am not sure about Okiya, I remember being very sad after Akai's death and then all of sudden Okiya shows up, there's a lot of hints for Okiya=Akai and it seems a bit TOO BEAUTIFUL and TOO EASY for me to believe . I think Okiya IS Akai, but wouldn't mind him actually being Borboun, just for the hell of it ;p.
;so i try to smile like i mean it and let myself let go
cause it's all in the hands of a bitter bitter man;
As for the cellphone bit: is it worth mentioning that Conan had two identical cellphones at that time? One for Conan and one for Shinichi.
As such, it is possible to have a unique set of fingerprints on either one. One could have Jodie, Conan's and the BO member in the hospital, and the other would have another set of people.
i really don't think Akai is dead... I just noticed that when he was shot by Kir, his right hand was in his pocket... that made me think that he activated the blood bag that probably was hidden inside his tuque... I also have other reasons as well but too lazy to put them down...
oh by the way does anyone know in what part of Kir's body the hidden camera was?

Well Conan wouldn't give away the Shinichi cell phone, because think about it, what happens if Ran calls and Jodie answers it? or some other FBI agent answers it?

Remember that Conan took out his SIM card before handing it to Jodie. The SIM card holds the cellphone number, if he puts his SIM card in another cell phone he that cell phone would have his original number. (All a cellphone holds is the text-messages and pictures (if it is a camera-phone)) Coincidentally, Conan erased all his personal information (text messages etc.) beforehand, it's almost as if he was PREPARED to give it to Jodie.
I believe that Akai faked his own death using Kusuda Rikumichi's body (the Black Organization operative who was sent in to search for Rena and later committed suicide when he couldn't get away).
As for how the Black Organization operative's fingerprints got on the Conan's cellphone. Remember in File 597 when Conan was trying to determine which of the three patients in the hospital was the Black Organization operative? He dropped his cellphone in front them and asked them to pick it up. Hence there are actually at least 6 people's fingerprints on the cellphone: the three suspects, Conan, Akai and Jodie.
As for the police report, all Takagi confirmed was that the fingerprints on the cellphone matched that of the body found in the car (File 609) as well as that there are many mysteries about the body. Since the bomb was placed next to the head and the hands in the pockets to protect them from getting burned, it should be pretty obvious that it's a setup to fake Akai's death.

What aobut text messages from Ran? they ain't stored in the phone's sim card.
