Even though this might have been solved, I have a different and possible logical answer

Notice that John, Frank, and Mark are Guy names
next we have
Ariel and Mary which are Ladies names
then you threw me a curve with Justin
But what if that was short for Justine which is also a Ladies name
then we get 3 Guys and 3 Ladies
Also note the guy name are in ascending alphabetical order
the same is true for the first Ladies names
next again we get Justine
So by those rules it seem it should be a ladies name and the only availible is Lucy
so I think maybe Lucy should be next
also
A- Carlos ( C is before J ) so not likely
B- Jack ( J is the same as J ) so not likely
C- Peter (Peter is a guys name and possible but already say to be wrong)
D- Lucy ( the only one left )

Is the pool square-shaped itself?
Are we supposed to make a people-square or maybe a waves-square?
For now I see three options:
- The "one" we should move is floating somewhere we can't see them. The whole pool doesn't fit the image. So just add one more person.
- One or more of the square's sides is the pool's edge.
- Instead of laying straight, the people make themselves more into the shape of L letter. Well, the one on the right already seems to be in that position.
Also... Is it important that they seem to be kinda dead, floating like that and with their clothes on?

Interesting, but I gotta say I picked up names at random. I did intend male and female names so as to confuse everyone, but never intended there to be another way to solve it.

We simply get one of them out of the water - then the police will arrive and mark a square place around the body with a "KEEP OUT" yellow tape! Freakin' BRILLIANT!
