I think this scene is right after Conan rejected Ai and then she made some other boy look like Conan and had a night with him

Oh, uhhh where did I get this from. Ahh damn I forgot what website. It had some nice pairing pic and when I saw how cute they looked together (especially ai DAMN x3) I just had to put as my sig. But I'm pretty sure I saw it when I google imaged conan and haibara too soo try there.

This is not an original. Aoyama doesn't draw this kind of lolicon stuff.
The line is not Aoyama's and what about the color...
This is an art from a doujinshi circle I guess.

Being the one with the chess quote and avatar...

If my theory is right, and Conan is his King, Ran his Queen and Heiji the opponent King, Conan should be ashamed of the situation on the board. It's a draw with Conan being a Queen ahead.
Conan's king does control the fields f7, g7 and h7 while "Ran" controls g8. The king on h8 can't move, but is not in check. That's a draw ("remis"). It's also not possible that it's Conan's turn because if it were, Heiji had just moved - which is impossible as well. The only possibility of this situation to be won for Conan is if Ran is a rook - which seems quite unlikely... (Ran is not a rook-type. And it would leave a question - who's Conan's Queen? (Although the AiCon-fans have an answer, of course. But this would make AiCon official, as it is not))

You are right that if it is Heiji turn the game is a draw, but
It could be conan turn and I will explain how. Heiji move as likely to move his king in to the corner. He can only how to draw and That is his best move. He hopes that conan will move the king is not the likely queen (Ran). The move before this one was likely Conan checking Heiji.
Conan best move now would be to move his queen to the row of Heiji's king and Mate him.
