As far as I can remember, there wasn't even one event showed that the FBI saw his dead body... It was just a confirmation by Takagi that the cellphones marks are the sames as the victim's. So anything can still happen.

Do you know Miyano-sama's idea with this other BO member? I think it is quite possible. And there was Conan's thought after Eisuke told him that something must have happened in the FBI (hopefully you can understand what I want to say >.<). He thought: Yeah, everything is fine. I also don't think Akai is dead.

But why this show than?
Well. First of all, they must have known that the BO wanted some prove of Kir's loyalty.
Second, the BO thinks Akai is dead and they don't reckon with him any more. Perhaps they get careless.
Third, perhaps he also wanted to "leave" the FBI, because he thinks he need to go another why or for some other reason.
