Snake is a member of the BO?

We don't know for certain that Snake was the one who killed Toichi, though. Only that the people with Snake did. If he was part of the BO, I imagine that it would have been Gin or someone who created an untraceable crime.

If anything, Snake would be part of an incompetent branch?

That's exactly what I've been thinking. We already know that Snake's signature kill is a single shot to the heart. The way Toichi died doesn't fit Snake's M.O. so I just can't accept the concept of Snake being the one who killed Toichi. Think of it this way: Snake's method is quick, precise, not exceedingly showy, it's obviously a case of murder and it isn't premeditated. The way Toichi was killed was extensively premeditated, it was very messy and it was made to look like an accident. Snake lacks both the finesse and psychological make-up needed to be capable of committing this kind of act.

Possibly Snake is a low-rank member, like Akemi; no proper alcoholic codename, just does whatever missions are handed out to him, not the most ranking or skilled member of the bunch. (I love Akemi, but she had several screwups in that heist, from choosing shitty partners to losing her cool and botching her disguise job.) I can see Gin or Vermouth being behind Toichi's death, and controlling Snake.

This does leave the possibility that someone higher-up will eventually deciding that Snake isn't up to the task of eliminating Kid, and sending someone better out...

That's likely what could have happened.

If that’s the case, then you might as well consider Ran an antagonist for wearing black. ;D

That's a good point because Haibara actually did said something to that extent during the Bus Jacking Case when Conan was freaked out by some man wearing black. Then there's the woman Conan thought was Black Org but was actually a red herring. You know, the case where Haibara was first introduced. I don't recall seeing Sherry wearing any black during the flashback when she still in the B.O either.
